COOPERATION AGREEMENT
BETWEEN
HONG KONG MEDIATION CENTRE
AND
WTC MACAU ARBITRATION CENTER
Hong Kong Mediation Centre
and
WTC Macau Arbitration Center
jointly referred to hereinafter as “the parties” have agreed as follows:
Both Hong Kong Mediation Centre and WTC Macau Arbitration Center have been established in Hong Kong and Macao, respectively, to promote the use of mediation and other appropriate alternative dispute resolution procedures in their respective regions.
Both parties desire to further their objectives by promoting the co-operation and development of mediation and alternative dispute resolution procedures in Macao and Hong Kong and for this purpose have entered into this Co-operative Agreement.
THE AGREEMENT:
1. The parties shall co-operate in the promotion of mediation and alternative means of dispute resolution within Hong Kong and Macao.
2. The parties shall endeavor to co-operate in the provision of the means of selection, education and training of potential and practising mediators as well as those practising other means of alternative dispute resolution.
3. The parties shall endeavor to co-operate in the setting up and running of conference and seminars on mediation and alternative dispute resolution.
4. The parties shall exchange information on mediation and alternative dispute resolution.
5. At the request of a party, the other party shall recommend persons suitable in its opinion to act as mediator or another type of dispute resolver.
6. At the request of a party, administrative services or any other service necessary for conducting mediations or alternative dispute resolution proceedings shall be rendered at a cost to be agreed before provision.
7. Subject to the above provision, or unless expressly otherwise agreed to by the parties, each party shall assume the costs of carrying out its objectives under this Agreement.
8. This Agreement shall take effect on the date of the Agreement.
9. Either party may terminate this Agreement at any time for whatever reasons.
